These Terms and Conditions (“Terms”) govern access to and use of Pistoia Life, including pistoialife.it, pistoialife.moltochic.app, and the services and content made available through the Pistoia Life web application.

By using Pistoia Life, users agree to these Terms.
1. About Pistoia Life
Pistoia Life is a tourism-oriented digital platform created to help visitors discover and experience Pistoia and its surrounding area.
The platform may provide information concerning attractions, cultural sites, accommodation, restaurants, food and drink, shopping, events, itineraries, local businesses, services and Experiences.
Pistoia Life may also promote Experiences offered by selected independent local businesses, professionals, organisations and other third parties (“Partners”).
2. Eligibility
Pistoia Life is intended primarily for adult users and adult tourists.
Users must have the legal capacity required under applicable law to make requests or enter into agreements with Partners.
3. Access to the Platform
Pistoia Life is available as a web application accessible through compatible smartphones, tablets and computers.
Access to the main content does not currently require user registration.
Pistoia Life may modify, suspend or discontinue features of the platform where reasonably necessary, subject to applicable law.
4. Tourist and Editorial Information
Pistoia Life aims to provide useful and accurate information concerning Pistoia and its territory.
Information may include, among other things:
opening hours;
prices;
addresses;
events;
availability;
menus and services;
attractions;
accommodation;
restaurants and food services;
shopping;
itineraries;
maps;
Experiences.
Some information is produced directly by Pistoia Life, while other information is supplied by Partners or third parties.
Although reasonable efforts are made to keep information accurate and up to date, opening hours, prices, programmes, availability, services and other information may change without notice.
Users are therefore encouraged to verify time-sensitive or important information directly with the relevant venue, organisation or Partner before travelling or making arrangements.
5. Selected Partners
Pistoia Life selects and reviews the businesses and organisations presented as Partners according to criteria determined by Pistoia Life.
Selection or inclusion on Pistoia Life does not make a Partner part of Pistoia Life and does not eliminate the Partner's responsibility for its own products, services, activities and conduct.
Partners remain independent entities unless expressly stated otherwise.
6. Pistoia Life Experiences
Pistoia Life may promote Experiences provided by independent Partners.
Pistoia Life acts primarily as a promotional and information intermediary and facilitates contact between users and Partners.
Unless expressly stated otherwise, Pistoia Life does not itself provide the Experience.
The Partner is responsible for the organisation, availability, execution, safety and delivery of its Experience and for compliance with applicable legal and professional requirements.
7. Experience Booking Requests
Users may be able to select a date or time slot and submit a request for an Experience through Pistoia Life.
Submitting a request does not constitute a confirmed booking.
The request is transmitted to the relevant Partner.
The booking becomes effective only when the Partner confirms the request directly to the user.
The Partner may contact the user at the email address supplied with the request.
8. Prices and Availability
Prices, availability and specific conditions relating to Experiences are supplied or confirmed by the relevant Partner and may change.
Pistoia Life seeks to display current information but cannot guarantee that information supplied by third parties will remain unchanged.
If the price, availability or material conditions communicated by the Partner differ from those displayed on Pistoia Life, the Partner should inform the user before the booking becomes final.
The user may then decide whether to proceed under the updated conditions.
9. Payments
Pistoia Life does not currently collect payment for Experiences.
Any payment is made directly between the user and the Partner providing the Experience.
The Partner is responsible for payment terms, invoicing or receipts, refunds and other payment-related matters.
10. Cancellations, Changes and Refunds
Cancellation policies, modification conditions, penalties and refund rules applicable to an Experience are determined by the Partner providing that Experience.
Users should review or request these conditions before confirming a booking.
Any cancellation or refund request relating to the Partner's service should normally be addressed directly to the Partner.
Mandatory consumer rights under applicable law remain unaffected.
11. Specific Experience Requirements
Experiences may be subject to requirements or restrictions established by the Partner, including:
minimum or maximum number of participants;
minimum age requirements;
accessibility conditions;
clothing or equipment requirements;
weather conditions;
safety requirements;
dietary or other participation requirements.
Users are responsible for reviewing relevant conditions before participating.
Allergies, food intolerances, health conditions, accessibility requirements or other particular needs should be communicated directly to the Partner before the Experience.
Users should not submit sensitive health information through Pistoia Life unless expressly requested through an appropriate process.
12. Partner Responsibility
Partners are responsible for the products, services and Experiences they provide.
Pistoia Life's role in promoting, selecting or presenting a Partner does not replace the Partner's own contractual or legal obligations towards the user.
Nothing in these Terms excludes or limits liability where such exclusion or limitation would be prohibited by applicable law.
13. User Reviews, Comments and Photographs
Pistoia Life may allow users to submit reviews, comments, photographs or other content.
Users remain responsible for content they submit and must have the necessary rights to publish it.
Users must not submit content that:
is unlawful;
is defamatory, threatening or abusive;
infringes intellectual property, privacy or other third-party rights;
is deliberately false or misleading;
constitutes spam or unauthorised advertising;
contains malicious software or harmful material;
is unrelated to the relevant content or service;
otherwise violates applicable law or these Terms.
Pistoia Life may moderate submitted content and may refuse, hide or remove content that reasonably appears to violate these Terms, applicable law or the rights of third parties.
14. Licence for User-Submitted Content
Where a user voluntarily submits content for publication on Pistoia Life, the user grants Pistoia Life a non-exclusive, royalty-free licence to host, reproduce, display and technically adapt that content as reasonably necessary to operate and promote the platform and the relevant content or service, subject to applicable law.
The user retains ownership of their original content.
15. Intellectual Property
The Pistoia Life name, logo, visual identity, graphics, original texts, photographs, layouts, databases and other original materials are protected by applicable intellectual property laws to the extent applicable.
Some materials displayed on Pistoia Life are provided by Partners or other third parties and remain subject to the rights of their respective owners.
Users may freely share links to publicly accessible Pistoia Life pages.
Unless permitted by law or expressly authorised, users may not copy, reproduce, republish, distribute, commercially exploit or systematically extract Pistoia Life content without prior permission from the relevant rights holder.
16. Pistoia Life Name and Logo
The Pistoia Life name, logo and visual identity may not be used in a manner suggesting endorsement, partnership, sponsorship or affiliation without prior authorisation.
Nothing in these Terms grants users ownership of or a general licence to use Pistoia Life branding.
17. Sponsored and Commercial Content
Pistoia Life may enter into commercial relationships with Partners and may receive fees, commissions, contributions or other compensation relating to promotion, visibility or bookings.
Commercial content or placements may, where appropriate, be identified using terms such as “Sponsored”, “Partner” or “Promoted”.
The existence of a commercial relationship does not make Pistoia Life the provider of a Partner's products or Experiences unless expressly stated otherwise.
18. External Links and Third-Party Services
Pistoia Life may contain links to Partner websites, booking services, Google Maps, Instagram, YouTube and other third-party services.
These services are operated independently and may be subject to their own terms and privacy policies.
Pistoia Life is not responsible for the operation, availability, security or content of independent third-party websites and services, subject to any liability that cannot lawfully be excluded.
19. Maps and Directions
Maps, geographical information, distances and directions are provided for convenience.
Users should not rely exclusively on Pistoia Life for navigation or safety-critical geographical information.
Users should follow official signage, road rules, local authorities' instructions and appropriate navigation services.
20. Acceptable Use
Users must not use Pistoia Life to:
engage in unlawful activity;
interfere with the security or operation of the platform;
attempt unauthorised access to systems or data;
distribute malicious code;
impersonate another person;
scrape or systematically extract content for unauthorised commercial purposes;
infringe the rights of Pistoia Life, Partners, users or third parties.
21. Availability of the Service
Pistoia Life aims to keep the platform available but does not guarantee uninterrupted or error-free access.
Maintenance, technical failures, third-party services, internet connectivity or circumstances outside Pistoia Life's reasonable control may temporarily affect availability.
22. Limitation of Liability
To the extent permitted by applicable law, Pistoia Life is not responsible for losses arising solely from inaccurate or outdated third-party information, independent Partner conduct, third-party websites or services, or circumstances outside its reasonable control.
Pistoia Life does not seek to exclude or limit liability where doing so would be unlawful, including mandatory rights and protections available to consumers.
23. Privacy
Personal data is processed in accordance with the Pistoia Life Privacy Policy and applicable data protection law.
Users should review the Privacy Policy before submitting personal information through the platform.
24. Changes to the Platform and Terms
Pistoia Life may update the platform and these Terms from time to time, including to reflect changes to services, technology, business operations or applicable law.
The current version of these Terms will be published through Pistoia Life and will indicate the date of the latest update.
Material changes will be communicated where required by applicable law.
25. Governing Law
These Terms are governed by Italian law, without prejudice to any mandatory consumer protection provisions that may apply to the user.
26. Jurisdiction
Subject to mandatory consumer protection rules concerning jurisdiction, disputes relating to these Terms or the use of Pistoia Life shall be subject to the jurisdiction of the Court of Lucca, Italy.
Where mandatory consumer law grants the user the right to bring proceedings before another competent court, that right remains unaffected.
